This privacy policy (“Policy”) applies to all products and services offered by Conversed.ai (“Conversed.ai”, “we” or “us”). If you have any questions about this Policy, please feel free to contact us via our website or email us at privacy@conversed.ai.
At Conversed.ai, we respect users' privacy rights and data protection rights. Our privacy policy is designed to help you understand what information we collect and how we use and share that information. We are committed to protecting your individual rights, in accordance with the GDPR (Regulation (EU) 2016/679), including:
- Your right to information.
- Your right of access.
- Your right to rectification.
- Your right to erasure.
- Your right to restriction of processing.
- Your right to data portability.
- Your right to object.
- Your rights regarding automated decision-making and profiling.
If you are a visitor to a Conversed.ai website, a recipient of communications from Conversed.ai, a customer of a Conversed.ai service, or a representative of a customer of a Conversed.ai service, this Privacy Policy applies to your use of any such Website or Service, except as expressly stated otherwise below.
If you are a visitor or user of a third-party website or service (“Third-Party Website/Service”) that utilizes communication or messaging products from Conversed.ai (such as the Conversed.ai chat widget), any information you submit to such Third-Party Website/Service (including through a Conversed.ai product) is collected under the privacy policy of the owner of that Third-Party Website/Service, and you should contact that owner for any related requests or questions.
Controller
Conversed.ai BV, with its registered office at J.M. Keynesplein 4, 1066 EP Amsterdam, is the Data Controller. As used in this Privacy Policy, “Conversed.ai”, “we” and “us” refer to Conversed.ai BV. “Websites” refers to the websites of Conversed.ai (including, without limitation, www.conversed.ai, platform.conversed.ai and any successor URLs, mobile or localized versions, and related domains and subdomains), and “Services” means Conversed.ai's communication and messaging products, applications, and services, in whatever form they may be offered now or in the future. The Websites and Services are hereinafter collectively referred to as the “Products”.
What information we collect
Registration and contact details
We collect information about you when you (a) register to use the Services and (b) otherwise provide us with contact information via email, postal mail, or through our Products. This information provided by you may include your username, first and last name, email address, postal address, or telephone number.
When you purchase the Services, we also collect transaction data, which may include your credit card information, billing and shipping address, and other payment-related information (“Payment Data”). How Payment Data may be collected and processed is described in the section entitled Payment Data below.
Information from third-party platforms
We may collect information when you interact with our advertisements and other content on third-party websites or platforms, such as social networking sites. This may include “likes,” profile information collected through social networking sites, or the fact that you have viewed or interacted with our content.
Other information
We may collect other information from you that is not specifically mentioned here. We may use such information in accordance with this Privacy Policy or as otherwise permitted by you.
Legal basis. Our legitimate interest.
Conversed.ai's products work together to help sales, marketing, and support teams communicate better with customers. To engage visitors and leads, we have a legitimate interest to collect relevant data and send messages based on this information. We take your privacy and data protection rights into account when pursuing our legitimate interests and ensure that the operation of our Products does not infringe upon these rights. For website visitors, Conversed.ai retains this data for 9 months; for sales and marketing leads, Conversed.ai retains this data until the individual in question unsubscribes, or until they have had no interaction with Conversed.ai for 24 months.
Customer details
You may submit various types of information and data into the Services for hosting and processing (“Customer Data”). Customer Data may include, without limitation, (a) billing information, personal data such as names, email addresses, phone numbers, location, and photographs of end customers, prospective customers, and other users and visitors of your websites, apps, and other properties (for example, team member data), which information may be entered by you into the Services or collected by the Services using tags, scripts, and other code from Conversed.ai implemented on such properties, and (b) information contained in communications between you and individuals using the messaging features of the Services.
We will only use, disclose, and otherwise process Customer Data for the purposes set forth in your agreement with us for the provision of the Services.
Legal basis
We process and store Customer Data to perform our Customer Agreement with you. Without this information, we would not be able to deliver our Products to you. We also process Customer Data to pursue our legitimate interests by ensuring the smooth execution of your Customer Agreement and to help your sales, marketing, and support teams communicate better with your customers. We take your privacy and data protection rights into account when pursuing our legitimate interests and ensure that the operation of the Products does not infringe upon these rights. Conversed.ai retains this data until the individual concerned opts out, or until we are legally required to keep your data stored.
Sources of the information we collect
From you. You are the primary source of the personal data we collect, including the Registration and Contact Data, Payment Data, and Customer Data that you provide to us through the Products or otherwise.
From other sources. We obtain personal data from other sources, such as:
- Other users who provide us with Customer Data of other persons.
- Third-party platforms, such as our advertising partners and content on third-party websites or platforms, including social networks.
How we use the information we collect
We use your information in the following ways:
- To provide, maintain, and improve the Products and our other products and services, including operating certain features and functionalities of the Products (for example, by remembering your information so that you do not have to re-enter it during this or subsequent visits);
- To process your questions and otherwise provide customer service;
- To process your payments, we share and use Payment Data as described in the section entitled Payment Data below;
- To manage unauthorized use or misuse of the Products and our other products and services, or otherwise to detect, investigate, or prevent activities that may violate our policies or are unlawful;
- To analyze trends, manage or optimize the Products, monitor usage or traffic patterns (including tracking user movements within the Products), and gather demographic information about our user base as a whole;
- To communicate directly with you, including by sending you newsletters, promotions, and special offers or information about new products and services. Your opt-out options for promotional communications are described in the section below titled Your Control Options and Choices; and
- In the manner described to you at the time of collection or as otherwise described in this Privacy Policy.
Interest-based advertising
We and our third-party advertising partners may use cookies and similar technologies to collect information about you (including the Technical, Usage, and Location Data described above) over time, through our Service and other sites and services, and through your interaction with our emails, and use that information to serve advertisements that they think will be of interest to you. These advertisements are called “interest-based advertisements.”.
Sharing your information with third parties
We do not share or provide your personal data to third parties, except in the following limited cases:
- We may share your personal data with our parent companies, subsidiaries, and affiliates;
- We may share your personal data with third-party service providers to enable these parties to provide services that assist us with our business operations, including support with marketing, advertising our product/service offerings, or delivering, maintaining, and improving the features and functionalities of the Product, among other things. For example, we may provide personal data to our service providers for directly sending our newsletters or notifications about our product/service offerings. The shared data may include name, job title, email address, message history, and company information. All third parties are contractually obligated to comply with appropriate security requirements and all applicable legislation;
- We may allow external companies to collect information about your activities on the Products and other online services to facilitate the delivery of interest-based advertising, and/or use hashed customer lists that we have shared with them to deliver ads to our customers and similar users on their platforms;
- We may share your personal data when we have a good-faith belief that access, use, preservation, or disclosure of such information is reasonably necessary to (a) comply with applicable laws, regulations, legal processes, or enforceable governmental requests, (b) enforce a Customer Agreement, including investigating potential violations thereof, or (c) protect against imminent harm to the rights, property, or safety of us, our users, or the public, as required or permitted by law;
- We may share your personal data with third parties (including our service providers and government authorities) to detect, prevent, or otherwise address fraud, security, or technical issues;
- We may share your personal data with our business partners who jointly offer a service to you, for example in the case of a joint promotional campaign;
- We may share your Payment Information to process your payments, as further described in the section entitled Payment Information below;
- We may share and/or transfer your personal data if we are involved in a merger, acquisition, bankruptcy, or any form of sale of (a part of) our assets; and
- We may share your personal data with a third party if you have given consent for this.
We may also share aggregated or anonymized information with third parties for other purposes. Such information does not.
We sometimes share your personal data with other companies and certain service providers that perform certain business activities on our behalf. This includes:
- Amazon Web Services, Inc.
- Google Ireland Limited.
- MongoDB, Inc.
- Microsoft Corporation.
Use of speech functionalities and sub-processors
Yes, we want to use the voice functionalities for the Conversed.ai AI Assistant. We have therefore agreed that Conversed.ai may engage ElevenLabs as a subprocessor under the terms of the data processing agreement between Conversed.ai and ElevenLabs. This agreement stipulates, among other things, that ElevenLabs may engage other subprocessors and that it may transfer personal data to countries outside the European Economic Area under strict conditions. The data processing agreement and the list of subprocessors can be found on ElevenLabs' website.
Payment details
When you make a purchase through the Products, any credit card information you provide as part of your Payment Information is collected and processed directly by our payment processor Stripe, via their Stripe Checkout service. We never receive or store your full credit card information. Stripe commits to complying with the Payment Card Industry Data Security Standard (PCI-DSS) and using industry-standard security. Stripe may use your Payment Information in accordance with their own privacy policy, which can be found at: https://stripe.com/us/checkout/legal.
Other access to or disclosure of your information
The Products may also contain links to third-party websites. This Privacy Policy applies solely to information collected by us. Even if the third party is affiliated with us through a business partnership or otherwise, we are not responsible for the privacy practices of any such third party. We encourage you to familiarize yourself with the privacy policies of such third parties to determine how they handle information they collect from you separately. Please note that we do not warn you when you choose to click through to another website while using the Products.
The Websites contain features that allow you to post reviews, comments, or other content that is publicly visible. You should be aware that personal data you submit as part of such posts can be read, collected, or used by other visitors of the Websites, and can be used to send you unsolicited messages. We are not responsible for the personal data you choose to make public on the Websites.
Your rights and choices
Opt-out options
We can offer you the opportunity to opt out of the use of your personal data for certain purposes when we ask for this information. If you decide to opt out, we may not be able to provide certain features of the Products to you.
Communication preferences
If you no longer wish to receive our newsletter and promotional communications, you can opt out by following the instructions included in such communications or on the Products. Please note that you may not be able to opt out of certain service-related communications.
How we respond to Do Not Track signals
Your web browser may have a “do not track” setting which, when enabled, causes your browser to send a do-not-track HTTP header or “signal” to every site you visit. At this time, the Products do not respond to this type of signal.
Data subject rights
You can view, rectify, delete, restrict, or export your personal data at any time by emailing us at privacy@conversed.ai. You can object to our processing of your personal data at any time.
Data portability
In accordance with the GDPR, in exercising the right to data portability, we will make our utmost best efforts to enable the data subject, where technically feasible, to download their personal data in a portable format so that they can transfer this data directly from one controller to another.
Right to lodge a complaint with a supervisory authority
In accordance with the GDPR, without prejudice to any other administrative or judicial remedy, every data subject has the right to lodge a complaint with a supervisory authority, in particular in the Member State of his or her habitual residence, place of work or place of the alleged infringement, if the data subject considers that the processing of personal data relating to him or her infringes this Regulation.
Accessing and updating your personal data
When you use our Products, we make a good faith effort to provide you with access to your personal information upon request and to either provide you with the means to correct this information if it is inaccurate, or to delete it at your request if it does not otherwise need to be retained by law or for legitimate business purposes. You can access, review, correct, update, change, or delete your information at any time. To do so, please contact us at privacy@conversed.ai with your name and the information you are requesting access to, correction of, or deletion of, or, if you use the Service, log in to your account, go to your profile, and make the desired changes. We may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort (for example, requests concerning information residing on backup tapes), jeopardize the privacy of others, would be extremely impractical, or for which access is not otherwise required. In all cases where we provide access to and correction of information, we do so free of charge, unless doing so would require a disproportionate effort.
Please note that if you stop using the Service, or if we terminate your access to the Service in accordance with your Terms and Conditions, you may no longer have the ability to view or update your information.
We may retain your information as necessary to support the Products, comply with our legal obligations, or resolve disputes. Please note that content you post may remain on the Products even after you stop using the Products or we terminate your access to the Products.
Changes to the Privacy Policy
We reserve the right to modify our Privacy Policy at any time. If we make changes, we will publish them and indicate the new effective date of the policy on this page. If we make material changes to this policy, we will notify you by email or via a notification on the Products.
No children under 16 years old
The Products are not intended for use by persons under the age of 16, and Conversed.ai does not knowingly collect or solicit personal data from persons under the age of 16. If you are under the age of 16, you must not attempt to register for the Products or send us any information about yourself, including your name, address, telephone number, or email address. In the event that we confirm that we have collected personal data from someone under the age of 16 without verification of parental consent, we will delete this information immediately. If you are a parent or legal guardian of a child under the age of 16 and believe that we may have information from or about that child, please contact us using the email address or postal address listed at the end of this Privacy Policy.
Security
The security of your personal data is important to us. We maintain various appropriate technical and organizational measures to protect your personal data. We restrict access to personal data about you to employees whom we reasonably believe need to come into contact with this information to provide products or services to you or to do their jobs. Furthermore, we have implemented reasonable physical, electronic, and procedural safeguards designed to protect personal data about you. When you enter sensitive information (such as your password), we encrypt this information during transmission using industry-standard Transport Layer Security (TLS) encryption technology. No method of transmission over the internet, method of electronic storage, or other security method is one hundred percent secure. Therefore, while we use reasonable efforts to protect your personal data, we cannot guarantee its absolute security.
Location of personal data
All our data is stored on servers located in EEA member states.
